The phrase “sex crimes” is a blanket term used to describe any of a number of crimes that involve sex. These include rape, sexual battery or sexual assault, and molestation charges. Sex crimes are all serious offenses that can come with severe penalties if convicted, and all sex crimes require convicted parties to register with the sex offender database. These potential penalties can seem daunting, but a good defense attorney can work with you to get your charges reduced or possibly even dismissed depending on the circumstances surrounding the alleged crime. If you want to discuss your case with a sex crime lawyer, the attorneys at Okabe and Haushalter can assist you.

Under Section 290 of the California Penal Code, all persons convicted of a sex crime must register as sex offenders. Refusal to register comes with penalties of its own, and in most cases, registration is lifelong. Registering makes your personal information (such as name, date of birth, address, mugshot photo and the nature of the criminal charges) available to local law enforcement, area schools, and the general public. In certain cases, it is possible for a registrant to ask for “undisclosed” status on the registry. Obtaining “undisclosed” status means that the data made available to the general public is limited, although personal data would still be available to law enforcement agencies and local schools.
The defense strategy used for a given allegation depends on its unique circumstances, but possible defenses for sex crimes include lack of credible witnesses to the alleged crime, explicit consent being given prior to the alleged act, lack of knowledge of the alleged victim’s age (in cases involving minors), lack of prior knowledge of the alleged victim’s intoxication, and more.
