Understanding Charges Of Indecent Exposure

Okabe & Haushalter Mar 28, 2011 Sex Crimes

In the state of California, sex crimes are taken seriously. This, however, is not always what people expect. Although sex crimes typically cover the crimes most often associated with this topic, such as rape, prostitution and sexual assault, there is another crime that can fall under this blanket term: indecent exposure.

According to Chapter 8 of the 2010 California Penal Code, indecent exposure is the criminal act of a person exposing themselves in a place that they will be seen and will either offend or annoy the people around them. It is also a crime to assist or counsel a person into exposing themselves – this is done in an attempt to the offender or sexually excited.

Upon a first conviction, this is typically tried as a misdemeanor. If the crime was done after entering a home, the convicted can face up to a year spent in state prison. For each subsequent conviction, the alleged criminal could be punished with a felony – and the penalties associated.

If you have recently been criminally charged with a sex crime such as indecent exposure, you do not have the luxury of taking your time. The criminal process moves quickly – you need to move just as fast to ensure that you aren’t getting left behind.
